By Caroline Simson (December 10, 2021, 3:19 p.m. EST) – The United States Supreme Court is set to resolve a 3-to-2 dispute over whether district courts can order the discovery of a overseas private commercial arbitration, bringing up the issue on Friday for the second time after another case raising the same issue was abruptly dropped earlier this year.
Judges granted certiorari to a petition brought by a U.S. unit of auto parts maker ZF Group, in which the company challenges a Michigan federal judge’s August order requiring the company to turn over documents to Hong Kong electronics maker Luxshare Ltd. for use in a billion dollar arbitration in Germany.
