Pay or jail – Barbados Today

A convicted man has been given six months to compensate a woman he stabbed in the stomach almost five years ago.

If Ferdinand Alexander Junior Cadogan of Fustic Village, St Lucy does not return the money to the complainant, he will spend three years in jail.

Cadogan, who is in his late 20s, was also placed on probation for two years and ordered to take conflict resolution and anger management counseling through the probation service.

Madam Justice Pamela Beckles gave him the combination of sentences on Thursday for unlawfully and maliciously injuring Aisha Griffith on November 22, 2017.

According to a victim impact statement, parts of which were disclosed by Supreme Court High Court Justice No. 5, Griffith said the incident was physically and emotionally painful and the healing process was excruciating. She said the ordeal traumatized her and said she still felt minor pain when standing for long periods.

The victim also indicated that compensation would be beneficial for the pain and suffering she endured and was adamant that it was not her wish that Cadogan be incarcerated.

Griffith said he was generally “not a bad person” but had anger issues.

In passing sentence, Judge Beckles said that although the offense was serious, particularly in view of the injuries, the threshold for a custodial sentence had not been met and the imposition of a non-custodial sentence freedom would be appropriate.

According to the facts, Cadogan and Griffith reside in the same neighborhood.

On November 22, 2017, around 10 a.m., Cadogan was outside his residence and told some people in the neighborhood that he and his then-girlfriend had made some noise. Griffith told her about treating people in a special way and she then had a chat with Cadogan’s girlfriend.

This resulted in a feud between Griffith and Cadogan which quickly escalated.

Cadogan hit Griffith in the neck with a stick and she responded by throwing a rock into her house.

He then slapped her twice with the flat of a cutlass. Other people in the area stopped him, and Griffith, who had fallen to the ground, got up and threw another rock in his direction.

Cadogan freed himself from the people holding him down, approached Griffith with a knife and stabbed her in the stomach.

The woman then fell to the ground and was later taken to hospital where she underwent surgery.
